Oregon's Measure 49 Will Stop $15 Billion in Measure 37 Development Claims

Washington_3 In Oregon, there are more than 7,500 Measure 37 claims filed since the Measure passed in 2004.  Only 1,821 of these claims seek a partition of three or fewer homes. Most are claims for large subdivisions, commercial development, industrial development, or unspecified development.  In total, these claims cover over 750,000 acres of land and demand a total $15 billion of Oregon taxpayer's money in compensation.  Most of these claims have been filed on Oregon's most productive farmland as well as in our precious, protected forestland.

I am against measure 49 because it allows the changes to be sold. I believe that if the land is sold it should be purchase under the rules in place at the time of purchase.

You say that it will stop $15 billion in claims. That is $15 billion that the State has taken from landowners over the last 100+ years. I am surprised that there were only 7,500 claims made. Those claims where from people asking for rights that the State abrogated.

I will admit that I have a dog in this fight. I made claims on 8 parcels of property. They have been under one owner since 1946, and have been in the family since 1889. Since 1946 the State has taken away my right to develop the property the way it was originally intended. First the county reduced the number of lots I could build on by making a minimum lot size 1/2 acre. Then the State told the counties that the housing density was still to high and they wanted 2 acre minimums on lot sizes, so the county set it to 2 acres. Now the push is to set them to a 5 acre minimum. So far the county has grandfathered us in and allowed us to stay at 2 acres however all it would take is for the current employees to retire and that could end. There is also talk of making Rural Residental a 10 acre minimum. They are slowly taking away the value of our land.

All I have asked for in my claims is that the State restore the land use to what it original was.
