Measure 37 Claim to Ignore Landslide Rules Along Hwy 26 by the Oregon Zoo
Remember the landslide this year that shut down half of Highway 26 near the Oregon Zoo?
Well consider this: Kelly Bruun filed a Measure 37 Claim with the city of Portland to develop homesites on 12 acres of extremely steep land above Highway 26 and opposite the Oregon Zoo. Bruun is seeking to waive environmental rules that address issues related to landslides and runoff.
It is claims like these that remind us that while Oregon property owners should have the right to develop a few homes on their land, developers who want to build subdivisions in places they just don't belong need to take into consideration regulations and rules that protect all of us from things like landslides on our major highways.
Measure 49 is on the ballot November 6, 2007 in Oregon. Measure 49 fixes the serious flaws of Measure 37, and allows individual property owners to build up to 10 homes on their land - while stopping the huge developers who want to build subdivisions, strip malls and even gravel pits in places they simply do not belong.
